NEW YORK, New York: A state court has granted a temporary ruling allowing 90 New York bars and restaurants to remain open past the 11 pm closing time ordered by the state.
The Saturday night decision by New York Supreme Court Justice Timothy Walker granted the bars and restaurants a preliminary injunction to operate according to their normal times.
Steve Cohen, an attorney representing the bars and restaurants, had argued that the pandemic curfew was not supported by science.
"This is probably the last-ditch opportunity for our clients to be able to get life breathed back into them. They were all hanging by a thread, and Judge Walker gave them a lifeline," said Cohen, as reported by television station WIVB.
In early February, Cohen's law firm had sued New York Governor Andrew Cuomo, seeking state data on the transmission of the COVID 19 virus.
At that time, Cohen said his clients wanted to review the state's evidence supporting New York's restrictions on businesses.
